Earlier this year Sharman sought to expand the FastTrack case to include a lawsuit against the big 5 music companies. Sharman had alleged that they had colluded to control music online and other cartel related offenses. Judge Wilson rejected Sharman's claims saying that Sharman is not a competitor in that market.

Now Sharman has announced that they are appealing that ruling. The appeal will largely be based on the synergies between Sharman and Altnet INC.

Given the fact that judge Wilson believes that Sharman operates a root supernode that helps control FastTrack and the fact that previous rulings in favor of Grokster and StreamCast have been based on control, it is far from a forgone conclusion that Sharman are going to win their case. In light of this delay tactics such as this and threats of appeals to Australian courts may form Sharman's best strategy.
