Afew days ago my friend told me that people can and will get caught for uploading and downloading music if they keep doing it. I'm aware of this but then I wondered what if they can get caught for downloading music only. I read on how they supposedly monitored these P2P programs and it seems to me that they can only trace uploaders? or am I wrong?

You are correct its mainly uploaders that get caught, in some programs like bittorrent, e-donkey where you upload the same files you are downloading some people have gotten the nasty letters that way.

But for the most part its people uploading and hosting files that have been busted.

Nulls is right. There are ways to protect yourself, like using peerguardian and CAWS.

I see, thanks. Guess I better use peerguardian then, the current P2P progam I'm using forces me to upload whatever file I have. X_x

Yes, most programs now make you upload the file you are currently downloading. From what I know, you can't turn this off in any program. But yes, most people who get busted are those who upload. And, you also have to think about this, the people getting caught are people sharing stuff from more main stream artists. If the artist is popular (or was popular), the chances are greater of getting caught when uploading stuff from that artist.

Well, I'm newbie here and mabye I've overlooked this..
but has anyone heard of this company scouring the web?
This article was posted at a hack site i belong to..

Contrary to popular belief it is not the RIAA who employee techs to spy on naughty people downloading copyrighted material, it's Bay TSP. Bay TSP is a comprehensive, automated 24x7 surveillance operating with worldwide coverage of:

Websites
All major P2P networks
65,000+ newsgroups
FTP sites
IRC
Auction/retail sites
The RIAA/MPAA are clients of Bay TSP who collect all the data and work out exactly what pirated movie or software application is popular each month and whom is downloading it.

According to Bay TSP last month, The Interpreter was the most popular movie after being downloaded 50,336 times, shortly followed by The Skeleton Key at 47, 348. Interestingly the most pirated software was SUSE Linux 9.0 at 78, 159 copies followed by Acrobat 7 at 43, 803.

The data is comprehensive pinpointing the peak time of day, average shared files per user and how this varies across different methods of sharing files. It's impressive that this kind of data can be extracted from file sharing networks, IRC and newsgroups to name a few but is it stopping piracy? You have to wonder whether said data is being collected until such a time when the companies have more power to act against those who pirate copyrighted materials.

My question is...
Since (to my understanding) peerguardian is out of buisness temporarily, and updates cannot be had, how do i block these jerks????-or are they already in the orginal database???
I already have blocked time warner several times!

Ok, Peerguardian isn't out of business. It's back up, and with a new site. Their new site address is http://phoenixlabs.org. Peerguardian lists are constantly updated. So their lists are up-to-date. Just go to their site and download the latest version of Peerguardian.

Their latest version of Peerguardian, version 2, uses much less resources. Usually around 1% (if that) CPU usage and about 1K of memory.
